Official Rules for the Ben’s Beginners Contest


The below Official Rules apply to the Ben’s BeginnersContest (hereinafter, "Contest") offered by Mars Food US, LLC. The purpose of this Contest is to promote parents cooking with their children as a means of teaching healthier eating habits for life. Cooking with your children makes for a great beginning!


To be eligible to participate in the Contest, a potential entrant (“Entrant”) must be: (i) above the age of majority in his/her state of residence; (ii) a parent or legal guardian of a child who is a student in Kindergarten through eighth grade at the time of entry and for the duration of the Contest (“Child”) and (iii) both Entrant and Entrant’s Child must be legal residents of the fifty (50) United States or the District of Columbia. Home schooled children in Kindergarten through eighth grade are also eligible to be selected for the Grand Prize. Employees, representatives, officers, and directors of Mars Food US (hereinafter, the “Sponsor”), and each of their respective affiliates, subsidiaries, agents, judges and advertising and promotion agencies, as well as immediate family (spouse, parents, siblings, and children) and household members are not eligible. Further, individuals that have won a prize or award from Sponsor within the preceding four (4) years are not eligible. NOTE: Entrant’s Child must be a student in Kindergarten through eighth grade for the entire duration of the Contest. A Child who is not in Kindergarten through eighth grade is not eligible to participate and will be disqualified from the Contest. The Contest is subject to all applicable federal, state and local laws.


Mars Food US, LLC, 1131 W Blackhawk St, Chicago, IL 60642 is the “Sponsor” of this Contest.


The Sponsor will be collecting personal information about Entrant and Entrant’s Child when Entrant submits an entry into the Contest. The Sponsor will use and share this personal information in order to fulfill the requirements of the Contest. For example, the Sponsor may share this personal information with third parties who are evaluating the photos, contacting Entrants, potential Finalists (as defined below) or a potential Grand Prize Winner (as defined below). By entering this Contest and agreeing to these Official Rules, Entrant hereby consents to the Sponsor using the personal information of both Entrant and Entrant’s Child in this manner.

In addition, the Sponsor will maintain the personal information that it collects in accordance with the Privacy Policy located at


The Contest will launch on August 13, 2018. Entries will be accepted between 12:00 p.m. Eastern Time (“ET”) on August 13, 2018 through 11:59 p.m. ET on October 7, 2018 (“Entry Period”). The 25 finalists will be selected on or about October 12, 2018. Unless otherwise noted, for all times provided in these Official Rules or in relation to the Contest, the applicable time zone shall be Eastern Daylight Time. Sponsor’s clock shall be the official time keeping device for the Contest.



During the Entry Period, a potential Entrant may enter by uploading an image that complies with the requirements set forth in Section F below to (the “Contest Site”). To upload an image go to the Contest Site and click on the option to “Enter Now”. From there, Entrants may select the option to either proceed to “Registration” or “Sign In.” Following selection of an option and completion of all required information, Entrants may upload an image of a recipe in compliance with the requirements set forth below.

Please note, upon initial upload of an image, the Entrant must provide the following required information PER child per entry:

  • Entrant’s First Name

  • Entrant’s Last Name

  • Email Address

  • Password (for returning)

  • Entrant’s Child’s First Name

  • Entrant’s Child’s Grade

  • Entrant’s Child’s School Zip and School Selection

  • Name for the Entry, describing the image or recipe. Each such name should be different from previous entries. Entry will be denied for any lewd or inappropriate language in the entry name, in Sponsor’s sole discretion.

The image and all required entry information is hereinafter referred to as “Entry Materials”. Once complete, Entrant must check the box that they have read and agreed to the Official Rules and click on the “Submit” button to send the Entry Materials to the Sponsor. All Contest entries must be submitted by 11:59 p.m. ET on October 7, 2018 to be eligible. Sponsor reserves the right request additional information from Entrants after the Entry Period has ended.

Please note that, following submission, Entrant may be presented the opportunity to share the submitted image on social media. Opting to share is not a requirement of entry.


To be eligible for any prize, Entrant must submit an image that meets the following requirements (“Image Criteria”):
  • Must be in one of the following formats for an image: JPG, PNG or GIF.
  • Must be a minimum of 500px x 500px and cannot exceed 10MB.
  • Must feature a completed rice dish or an in-progress rice dish.
  • Must have Entrant and Entrant’s Child visible in the image so that they are clearly a parent/adult and child (i.e., faces must be visible).
  • Multiple children may be visible in the photo, but only one child will be considered the Child for purposes of the Entry and Entrant must be parent/legal guardian of all pictured children.
  • Must showcase safe cooking practices. Entrant’s Child shall not be left alone close to an open flame, use a sharp knife or practice any other cooking method deemed to be “unsafe” by Sponsor in Sponsor’s sole discretion
  • No Logos on clothing/hats allowed other than UNCLE BEN’S® brand apparel. Try to eliminate logos on any product or item shown in the image.
  • Blurry photos not accepted.
  • Must be uploaded through the digital hub at Contest Site.
  • No copy may be displayed on image (e.g., watermarks, words, symbols, etc.).
  • Must be within the general spirit of the Contest and meet the following additional legal requirements:
    1. Must not violate or infringe the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity, privacy or other proprietary rights (see “Warranty” under Section G for more details);
    2. Must not be unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, or contain explicit or graphic descriptions or accounts of, sexual acts, or otherwise contain any other content that is objectionable;
    3. Must not contain profanity or other lewd or inappropriate language, in Sponsor’s sole discretion;
    4. Must not victimize, harass, degrade, or intimidate an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
    5. Must not depict children unless the child’s parent or legal guardian is also depicted;
    6. Must be within the general spirit and guidance of the Program, including meeting the terms of these Guidelines;
    7. Must not contain an advertisement or solicitation not affiliated with the UNCLE BEN’S® brand;
    8. Must not contain any imagery, content or other element that is owned by a third party. Specifically, if any such content is present in the image, the Entrant must warrant that s/he is the creator and owner of such content;

In the event that Entrant’s image fails to meet the above Image Criteria, Sponsor will notify Entrant via email that the image was rejected. In some instances, and depending on the content of the image and the reason for the rejection, Entrant may be permitted to resubmit an image, in Sponsor’s sole discretion.

To be eligible, the Sponsor must receive Entry Materials during the Entry Period. Entry Materials that arrive after the end of the Entry Period will not be considered, except at Sponsor’s sole discretion. The Sponsor will notify Entrant when the image is posted on the Contest Site. It may take several days for the Sponsor to provide Entrant with such notice.

LIMIT: EACH ENTRANT MAY SUBMIT ONLY ONE (1) ENTRY PER CHILD PER DAY. This means that Entrant may enter as many times as they like, but that the image must be different per child per day. Day is defined as 12:00:00AM ET to 11:59:59PM ET. Any Entry Materials in excess of this limit will not be eligible or otherwise considered by the Sponsor. All Entry Materials become the property of the Sponsor. They will not be returned or acknowledged. The Sponsor is not responsible for lost, late, misdirected, incomplete, illegible entries or Entry Materials, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Entries and Entry Materials will be considered void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced or obtained through fraud or theft, or if they violate the Image Criteria. By participating, Entrant agrees to be bound by these Official Rules.


Warranty. By entering the Contest, Entrant warrants and represents that the image submitted by Entrant is his/her own original work created and recorded by Entrant and Entrant’s Child, has not been previously published, has not won a previous prize or award, that Entrant owns or otherwise controls all of the rights to the Entry Materials and the image submitted by Entrant (including, without limitation, the rights in any background photographs or other images present within the image) and that the image submitted by Entrant does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, trademark, publicity and/or privacy. Please understand that submitting an image that is copyrighted by another individual, or otherwise subject to the rights of another individual, will make Entrant responsible for any legal action the legal copyright holder might take against Entrant or in relation to the image.

License. By submitting an Entry into the Contest, Entrant and Entrant’s Child grant to the Sponsor the right, without limitation, to display the Entry Materials, including without limitation the image and the recipe, online and in any media now known or hereinafter developed. Further, Entrant and Entrant’s Child agree to grant to the Sponsor all rights of ownership, reproduction, and use of the Entry Materials, including without limitation the image and the recipe, for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, license, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit the Entry Materials, including without limitation the image and the recipe, for commercial or non-commercial use, and without compensation to Entrant or Entrant’s Child.


There will be two levels of recognition in the Contest and one level of prizing: (1) the Finalist Recognition and (2) the Grand Prizes with recognition.

(1) Finalist Recognition

As explained below, the Sponsor will recognize up to twenty-five (25) Finalists that it selects during the Contest judging (as explained in Section J of these Rules). For the purposes of these Rules, the term “Finalist” shall mean both the Entrant and Entrant’s Child who appear in the Entrant’s image.

Each Finalist will be recognized through Uncle Ben’s social media postings and a national press release (“Finalist Recognition”).

NOTE: A Finalist may opt out of receiving Finalist Recognition.

(2) Grand Prize

As explained below, the Sponsor will award a Grand Prize to five (5) of the Finalists. For the purposes of these Rules, the term “Grand Prize Winner” shall mean both the Entrant and the Entrant’s Child.

Each Grand Prize Winner will receive (i) a check for $15,000 and (ii) a check made out to the Child’s school to be used toward a cafeteria makeover valued at $30,000. Specifically, the Grand Prize will include the following:
  1. A check for $15,000 made payable to the winning Grand Prize Entrant.
  2. A check made out to the winning Grand Prize Entrant’s Child’s school to be used toward a cafeteria “makeover,” including cafeteria supplies, cafeteria payroll, remodeling, POS systems, cafeteria décor, etc. valued at no more than $30,000. The funds will be used at the school’s discretion and not monitored by the Sponsor. In the event the winning Grand Prize Entrant’s Child is homeschooled as of the date of Entry into the Contest, the Sponsor will award the $30,000 school cafeteria makeover to a school in the winning Grand Prize Entrant’s Child’s region (as determined by Sponsor), including one affiliated with the homeschooled student or one that is underprivileged, as determined by the U.S. Department of Education’s Title I funding program.
  3. Optional media appearance(s) to recognize the Grand Prize Winners.
The approximate retail value (“ARV”) of each Grand Prize is $45,000. The total ARV of all Prizes: $225,000.


The Sponsor may, at its sole discretion, choose to substitute any one of the prizes described in these Official Rules for one of equal or greater value. Further, the Sponsor reserves the right to expand or modify any of the prizes described above. Except for the cash award to the school, no prize transfer, assignment or substitution by the Grand Prize Winner is permitted. With respect to the cash award for the school, and if the Child’s school is unable or unwilling to accept the award -- including all terms pertaining to the award -- for any reason, the prize may be awarded to a school in the winning Grand Prize Entrant’s Child’s region (as determined by Sponsor) that is underprivileged, as determined by the U.S. Department of Education’s Title I funding program.

All federal, state and local taxes, fees and surcharges on the Grand Prize are the sole responsibility of the Grand Prize Winner. If any prize or prize notification is returned as undeliverable, the prize shall be considered forfeited and the Sponsor may select an alternate Grand Prize Winner from all remaining eligible entries based upon overall score. The odds of winning depend on the number of eligible entries received and the skill of the Entrants in preparing their images. Limit of one prize per person/per household.

The Sponsor and each of their respective affiliates, subsidiaries, employees, agents, officers and directors, advertising and promotion agencies, and their respective officers, directors, employees and their respective agents will not be liable for unsuccessful efforts to notify any potential winner.


There will be several phases to the review process and winner determination:


On or about October 12, 2018, twenty five (25) potential Finalists will be selected based on the following judging criteria of the submitted images. Five alternate selections will also be pulled at this time.

  • 25% based on creativity
  • 25% based on presentation of the dish
  • 25% based on appetite appeal
  • 25% based on reflection of the Ben’s Beginners goal of bringing families together to cook

Each Child can only be featured in one Finalist entry despite having submitted multiple entries. Multiple children from the same family are eligible to be selected. The judges reserve the right, but not the obligation, to interview any of the Entrants. The judges will give each image a score based upon the criteria listed above. The twenty-five (25) Entrants with the highest scores will be chosen as potential Finalists. In the event of a tie, the potential Finalist will be determined based upon the highest score in the category “reflection of the Ben’s Beginners goal of bringing families together to cook”. Judges’ decisions are final.

Once the Top 25 selections are complete, potential Finalists and the five alternatives will be notified by email and/or telephone on or about October 12, 2018 and each potential Finalist and alternate will be required to execute and return, by the end of the day on October 16, 2018, an affidavit of eligibility, assignment of rights, liability and (where legal) publicity release (“Prize Documents”), which will include, without limitation, their granting of permission for their names, likenesses, recipes and images to be displayed in connection with all advertising for Sponsor and the Contest and in any manner or in any media, now known or hereinafter developed by the Sponsor. Potential Finalists and alternates must sign the Prize Documents on behalf of Entrant’s Child, and consent to Entrant’s Child’s participation and acceptance of the prize. Potential Finalists and alternates must provide the Prize Documents to the Sponsor electronically, via the mechanism described by the Sponsor in the prize notification. The Prize Documents will also confirm the Finalist’s or alternate’s agreement to accept the Grand Prize if eventually chosen as a Grand Prize Winner. The Finalist or alternate must also warrant that the image and recipe have not previously won a prize or award. Any prize may be forfeited or a potential winner disqualified if there are any issues with acceptance of any prize during this process. Specifically, if notification documents are returned as non-deliverable, if a Finalist is found to be ineligible or not in compliance with these Official Rules, does not respond within the time period specified, or cannot accept the terms and conditions of being a Finalist or Grand Prize Winner, such Finalist or Grand Prize Winner may forfeit the prize and Sponsor may award the prize to the next highest scoring alternate.


Following confirmation of the 25 Finalists, the top 25 will be featured on the digital hub of the Contest Site in a Voting Gallery. Between the dates of October 17, 2018 at 12:00:00 PM ET and, November 11, 2018 until 11:59:59 PM ET (“Public Voting Phase”), the public can vote for the Finalist Entry Materials that best meet the goal of the Contest. Limit one vote per person/per IP address, per photo, per day. This means that persons may vote for more than one photo per day, but they may not vote for the same photo more than one (1) time per day. Day defined as once in a time period from 12:00:00 AM ET to 11:59:59 PM ET. Votes must be recorded by the Sponsor’s server by 11:59:59 PM ET on November 11, 2018. Please note: Voters are required to provide an email address as their verification as well as complete the required CAPCHA.


FINAL JUDGING. A panel of judges who are Sponsor’s employees and advertising/marketing partner affiliates will evaluate each of the Finalist’s Entry Materials to determine the Grand Prize Winners. This final judging period will occur between the dates of October 17, 2018 – November 16, 2018.

Specifically, to select the 5 winners, the judges will consider the following judging criteria:
  • 20% based on creativity
  • 20% based on presentation of the dish
  • 20% based on appetite appeal
  • 20% based on reflection of Ben’s Beginners goal of bringing families together to cook
  • 20% based on Votes received on the Contest Site during the Public Voting Phase

The judges will give each entry a score based upon the criteria listed above. The Finalists with the highest scores will be chosen as potential Grand Prize Winners. In the event of a tie, the potential Grand Prize Winners will be determined by the highest score in the category of “The total number of votes that the Photo received on the Contest Site during the Public Voting Phase.” Judges’ decisions are final.


Potential Grand Prize Winners will be contacted on or about November 16, 2018 and announced on social media on or about December 14, 2018. They will also be asked to provide information related to their schools in order to provide the school portion of the prize. Schools will be required to sign documentation in connection with the award.

NOTE: Please note that a school may be disqualified from receiving the cafeteria makeover portion of the Grand Prize if it refuses to complete any of the affidavits or prize documents provided to it. In such case, Sponsor reserves the right to award such portion of the prize to another school or entity selected by Sponsor, in Sponsor’s sole discretion. All prize details and decisions are at Sponsor’s sole discretion.


Except where prohibited by law, submission of an entry in the Contest indicates an Entrant’s consent to the Sponsor, each of its respective partners, affiliates and/or subsidiaries, use of Entrant and Entrant Child’s Entry Materials and materials obtained over the course of the Contest, including without limitation their names, likenesses, photographs, city/state of residence, school names, Entry Materials, including images and/or recipes, for advertising and publicity purposes in any and all media worldwide (including winners list) without additional compensation or notification. The names of all winners and those receiving recognition may be utilized in communications and advertising, including being posted on the websites of the Sponsor, its partners, affiliates and/or subsidiaries.


The Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. If the Sponsor, in its sole discretion, determines that the Contest or any portion of the Contest is impractical, fraudulent, void, unlawful or if there are any technical or administrative malfunctions, errors or other problems that affect the structure, terms or lawful administration of the Contest, the Sponsor may terminate, cancel or otherwise modify the Contest, in whole or in part.


By participating, Entrants and winners release the Sponsor, its respective affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising and promotion agencies, as well as all others associated with the development and execution of the Contest (collectively, the “Released Parties”), from and against any and all liability with respect to or in any way arising from the Contest, the prizes awarded in the Contest or in any filming, use or other activities related to the prizes offered in the Contest. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to the Contest Site, or any registration, voting or Grand Prize Winner/Finalist selection.

Entrants also agree (a) to be bound by these Official Rules; and (b) that the decisions of the Sponsor are final on all matters relating to the Contest.

Before being declared a winner or receiving any form of recognition, each selected Entrant may be required to sign an agreement and release confirming compliance with these Official Rules and acceptance of the prize as offered and (i) releasing the Released Parties from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from, and (ii) granting the Sponsor, and its agencies the unrestricted rights, in their collective or individual discretion, to publish without any further compensation the Entrant’s Child’s school’s name, Entrant’s and Entrant’s Child’s names, hometowns, likenesses, Entry Materials, including images and recipes, statements or prize information for advertising and publicity purposes worldwide without limitation and without additional compensation, except where prohibited. The agreement and release must be returned within the time period specified thereon or the selected Entrant will be disqualified and the prize forfeited.

If Entrant is acting within the scope of his or her employment, as an employee, contractor, or agent of another party, Entrant warrants that such party has full knowledge of his or her actions and has consent thereto. Entrant further warrants that his or her actions do not violate the employer’s or company's policies and procedures.


The Contest is governed by the laws of Illinois, without regard to the conflicts of law provisions.

All disputes, claims or demands that relate to these Official Rules will first be brought to the attention of the other party and will be resolved individually, without resort to any form of class action. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within 60 days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within 21 days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third party mediator chosen by the parties. If the parties do not agree to conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Official Rules will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Official Rules, shall be submitted to JAMS for binding arbitration under its rules then in effect in the Chicago, Illinois, metropolitan region, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
